1. Acceptance of Terms

By downloading, installing, or using the Nigel application or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you ("User" or "you") and the developer of Nigel ("we," "us," or "our"), an independent developer based in Taiwan. We may update these Terms at any time, and your continued use of the Service after such updates constitutes your acceptance of the revised Terms.

You must be old enough to use the Service under the laws of your country or region. If you are under the age of majority or the applicable age of digital consent in your country or region, you may use the Service only with permission from a parent or legal guardian.

2. Service Description

Nigel is an AI-powered personal styling application that provides the following capabilities:

  • AI Fashion Analysis: Our AI analyzes user-uploaded outfit photographs to detect and identify individual fashion pieces, including clothing items, footwear, and accessories.
  • Digital Wardrobe Management: Users can build and organize a digital wardrobe from their detected fashion pieces. Isolated product images are generated for each item.
  • Styling Recommendations: An AI agent named Nigel provides personalized outfit recommendations and styling advice through a conversational chat interface.
  • Flatlay Generation: The Service generates editorial-style flatlay compositions from wardrobe items for outfit planning and visual inspiration.

The Service operates on a credit-based system. Certain AI-powered features — including image isolation, AI look generation, flatlay generation, and restyling — may require credits to use. Credits can be purchased through in-app purchases within the iOS application. Basic AI agent chat is available without credit cost, subject to daily usage limits.

Credit balances are non-transferable and non-refundable except as required by applicable law or the policies of the platform through which the purchase was made (e.g., Apple App Store refund policies). We reserve the right to modify credit pricing, credit costs for features, and daily usage limits at any time, with notice where required by applicable law or where reasonably practical.

3. User Accounts

To access the Service, you must create an account using an email address and password, Google OAuth sign-in, or Sign in with Apple, powered by Supabase Authentication infrastructure.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Providing accurate and current account information
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or the integrity of the Service.

4. User Content & Uploads

Ownership: You retain full ownership of all photographs, images, and other content you upload to the Service ("User Content"). We do not claim ownership of your User Content.

License Grant: By uploading User Content, you grant Nigel a limited, non-exclusive, worldwide, royalty-free license to process, store, analyze, and use your User Content solely for the purpose of providing the Service to you. This includes transmitting your images to third-party AI processing services as described in our Privacy Policy.

Image Storage: Your uploaded images and AI-generated isolated product images are stored in Supabase Storage with user-scoped access controls. Through the app, only the authenticated account owner can access their own images. Infrastructure providers and limited operational access may process this data as described in our Privacy Policy.

Content Standards: You represent and warrant that your User Content does not:

  • Infringe the intellectual property rights of any third party
  • Contain nudity, explicit sexual content, or graphic violence
  • Depict minors in inappropriate contexts
  • Violate any applicable law or regulation

We reserve the right to remove User Content that violates these standards without prior notice.

5. AI-Generated Content

The Service uses artificial intelligence models, including Google Gemini (accessed both directly and through the OpenRouter routing layer), to generate styling recommendations, isolated product images, and flatlay compositions (collectively, "AI-Generated Content").

AI Interaction Disclosure: When you use the chat feature, you are interacting with an automated AI system named Nigel. Nigel is not a human stylist. Responses are generated by AI and may not always be accurate or appropriate to your specific situation.

Not Professional Advice: AI styling recommendations provided by Nigel are for personal entertainment and inspiration only. They do not constitute professional fashion advice, and we make no representations that the advice is suitable for any particular purpose, occasion, or individual.

Accuracy Disclaimer: AI models may produce inaccurate, incomplete, or unexpected results. Fashion piece detection, color identification, style categorization, and outfit recommendations may not always reflect accurate information about your actual clothing or personal preferences. We do not guarantee the accuracy of any AI-generated analysis or recommendation.

Personal Use: AI-Generated Content, including isolated product images and flatlay compositions, is provided for personal use only. Commercial use of AI-Generated Content derived from our Service requires our prior written consent.

Third-Party AI Models: We use Google Gemini AI models, accessed both directly and through the OpenRouter routing layer, for image analysis and content generation. Your use of AI-generated features is additionally subject to Google's Generative AI Terms of Service, OpenRouter's Terms of Service, and applicable data processing terms. Please refer to our Privacy Policy (Section 5) for full details on third-party data processing.

6. Intellectual Property

Nigel Intellectual Property: The Nigel name, logo, application design, user interface, user experience, underlying technology, AI model configurations, proprietary algorithms, and all associated materials are the exclusive intellectual property of the developer of Nigel and are protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

Your Content Remains Yours: As stated in Section 4, you retain ownership of all User Content you upload to the Service. The license you grant us is limited to the purpose of operating the Service.

Restrictions: You may not copy, modify, distribute, sell, sublicense, or create derivative works based on Nigel's intellectual property without our express written permission.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Upload images containing illegal content, including child sexual abuse material
  • Use the Service to harass, abuse, or harm other individuals
  • Attempt to reverse engineer, decompile, or disassemble the application or its AI models
  • Scrape, crawl, or use automated tools to extract data from the Service
  • Impersonate another person or misrepresent your identity
  • Use the Service in any manner that could overload, damage, or impair its infrastructure
  • Attempt to gain unauthorized access to any portion of the Service or its related systems
  • Upload content that contains malware, viruses, or other harmful code
  • Use the Service to generate content that violates intellectual property rights of third parties

Violation of these acceptable use restrictions may result in immediate termination of your account and, where appropriate, referral to law enforcement authorities.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER OF NIGEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR SERVICE INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

Without limiting the foregoing, we expressly disclaim liability for:

  • Inaccurate AI-generated styling recommendations or fashion analysis
  • AI-generated images that do not accurately represent your clothing or intended appearance
  • Decisions made based on AI styling advice, including but not limited to purchasing decisions
  • Any loss or corruption of User Content due to technical failures
  • Third-party services (including Google AI and Supabase) and their data handling practices

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Termination

Termination by You: You may delete your account at any time from Settings in the iOS app. You may also contact us for help with account deletion at [email protected].

Termination by Us: We may suspend or terminate your access to the Service immediately for violation of these Terms. In other cases, we may provide advance notice where required by applicable law or where reasonably practical.

Data Deletion: Upon account termination, we will make commercially reasonable efforts to delete your personal data and User Content within a reasonable timeframe, except where we are required to retain certain data by applicable law or for the resolution of disputes.

Sections of these Terms that by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law — shall survive any termination of your account.

10. Indemnification

You agree to defend, indemnify, and hold harmless the developer of Nigel from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) your User Content; (c) your violation of any third-party right, including intellectual property rights; or (d) any claim that your User Content caused damage to a third party. This indemnification obligation will survive termination of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the application, by email to the address associated with your account, or by updating the "Last Updated" date at the top of this page.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must discontinue using the Service and may delete your account from Settings in the iOS app or contact us for assistance.

12. Dispute Resolution

Before initiating any legal proceeding related to these Terms or the Service, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, it shall be submitted to the courts specified in Section 13.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Taiwan (Republic of China), without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Taipei District Court, Taiwan.
